Terms of Sale

These Terms of Sale apply to every order placed through the MagnetDex Site and form part of the binding contract between you (the "Customer") and MagnetDex (the "Seller"), together with our Terms of Service, Shipping Policy, Refund Policy, and Privacy Policy. By placing an order, you accept these Terms of Sale in full.

1. Products

MagnetDex sells blind-box fridge magnets: each pack contains a random selection of designs from the current collection, and the specific pieces you receive cannot be chosen, requested, or guaranteed in advance. This random-selection mechanic is a core, clearly disclosed feature of the product, not a defect, and is accepted by you at the time of purchase. We do not guarantee the availability, restock, or continued production of any specific design.

2. Prices and Payment

All prices are displayed in the currency applicable to your market (e.g. USD, EUR, GBP, AUD) and include any taxes required to be shown at that stage, unless stated otherwise. Prices are subject to change at any time without notice; the price displayed at the time your order is confirmed is the price that applies to that order. Shipping costs are shown separately at checkout before you confirm your order. Payment is processed securely through Shopify's checkout and its payment partners; MagnetDex does not store your full payment card details. We reserve the right to refuse or cancel any order, at our sole discretion, including in cases of suspected fraud, payment failure, pricing or listing errors, or suspected reseller/bulk-purchasing activity, with a full refund issued for any amount already charged.

3. Order Acceptance

An order confirmation email indicates that we have received your order; it does not constitute our acceptance of it. Our acceptance occurs when we dispatch your order. This does not affect your statutory right of withdrawal described below.

4. Shipping, Delivery, and Risk of Loss

Estimated processing and delivery times are set out in our Shipping Policy and are estimates only, not guaranteed delivery dates. If you are not an EU/EEA/UK consumer, risk of loss or damage to products passes to you upon our handover of the order to the shipping carrier. If you are a consumer resident in the EU, EEA, or UK, risk passes to you only once you (or a person you designate) physically takes possession of the goods, in accordance with applicable consumer law.

5. Right of Withdrawal (EU / EEA / UK Consumers)

If you are a consumer in the EU, EEA, or UK, you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason, in accordance with Directive 2011/83/EU (and equivalent UK law). This right cannot be reduced, waived, or excluded by these Terms. Full details on how to exercise this right, and how refunds are processed, are set out in our Refund Policy.

6. Non-EU/EEA/UK Customers — Final Sale

If you are not resident in the EU, EEA, or UK, all sales are final except as set out in Section 7 (Conformity) and in our Refund Policy.

7. Conformity and Warranty

We are responsible for delivering products that conform to their description on the Site at the time of delivery. This warranty does not cover: (a) the random selection inherent to the blind-box format; (b) damage caused by misuse, negligence, or unauthorized modification after delivery; or (c) normal cosmetic variation between units. If you receive a product that is damaged, defective, or materially different from its description, contact us at support@magnetdex.com with your order number and evidence of the issue, and we will offer a replacement or refund in accordance with applicable consumer law and our Refund Policy.

8. Cancellations

Orders enter processing shortly after they are placed. We cannot guarantee that a cancellation or change request will be honored once an order has entered fulfillment. This does not affect your statutory right of withdrawal if you are an EU/EEA/UK consumer.

9. Fraud and Chargebacks

Filing a fraudulent or unjustified chargeback instead of contacting us directly is a breach of these Terms. We reserve the right to dispute any chargeback we believe to be unjustified, to recover any resulting costs and fees, and to refuse future service to any customer who abuses the chargeback or refund process.

10. Retention of Title

Ownership of the products remains with MagnetDex until payment has been received in full.

11. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including carrier disruptions, customs delays, natural disasters, or supply chain interruptions.

12. Liability

To the maximum extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order, except where liability cannot be limited under applicable law (including for death, personal injury, fraud, or mandatory consumer protections available to EU/EEA/UK consumers).

13. Language

These Terms of Sale are drafted in English. Where a translated version is made available, the English version prevails in the event of any conflict, to the extent permitted by applicable law.

14. Governing Law and Disputes

These Terms of Sale are governed by Spanish law and disputes are subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protections — including the right to bring proceedings in your own country of residence — available under the law of your country of residence if you are an EU, EEA, or UK consumer.
