Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MagnetDex website (the "Site"). By browsing or using the Site, you agree to be bound by these Terms in full. If you do not agree, you must not use the Site. Terms relating specifically to purchases are set out separately in our Terms of Sale.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or place an order on the Site. By using the Site, you represent and warrant that you meet this requirement.

2. Prohibited Conduct

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to our systems, accounts, or data; interfere with or disrupt the Site's operation (including through bots, scraping, scripts, or denial-of-service activity); reverse-engineer or attempt to extract the Site's source code; place orders using fraudulent payment information; abuse our refund, chargeback, or promotional systems; impersonate any person or entity; or copy, reproduce, or exploit any content, images, or materials from the Site beyond what is expressly permitted by law. We reserve the right to investigate and take appropriate legal action, including reporting to law enforcement, against anyone who violates this section.

3. Accounts and Termination

If you create a customer account, you are solely responsible for keeping your login credentials confidential and for all activity under your account. We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or terminate any account or order, and to refuse service to anyone, where we reasonably suspect fraud, abuse, a violation of these Terms, or any activity that may harm MagnetDex, our customers, or third parties.

4. Intellectual Property

All content on the Site — other than content you submit yourself (such as reviews) — remains the exclusive property of MagnetDex or its licensors. No license or right is granted to you except the limited right to view the Site for personal, non-commercial shopping purposes. Any other use requires our prior written permission.

5. Third-Party Links and Services

The Site may link to third-party websites or use third-party services (including Shopify and payment providers). We are not responsible for, and expressly disclaim all liability arising from, the content, policies, security, or practices of third parties.

6. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. NOTHING IN THIS SECTION AFFECTS ANY STATUTORY RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING THOSE OF CONSUMERS RESIDENT IN THE EU, EEA, OR UK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGNETDEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) 100 EUR. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING FOR DEATH, PERSONAL INJURY, FRAUD, OR MANDATORY CONSUMER PROTECTIONS AVAILABLE TO YOU AS A RESIDENT OF THE EU, EEA, OR UK.

8. Indemnification

You agree to indemnify, defend, and hold harmless MagnetDex and its owner(s) from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

9. Dispute Resolution

If you are not resident in the EU, EEA, or UK, you and MagnetDex agree that any dispute arising from these Terms or your use of the Site will first be attempted to be resolved informally by contacting us at support@magnetdex.com, and failing that, will be subject to the exclusive jurisdiction of the courts of Spain, with each party bearing its own costs to the extent permitted by law. If you are a consumer resident in the EU, EEA, or UK, nothing in this section limits your right to bring proceedings in the courts of your own country of residence, or otherwise affects the mandatory consumer protections available to you.

10. Force Majeure

We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, labor disputes, carrier disruptions, or supply chain interruptions.

11. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. We may assign these Terms at our discretion; you may not assign them without our written consent. These Terms, together with our Terms of Sale, Refund Policy, Shipping Policy, Cookie Policy, and Privacy Policy, constitute the entire agreement between you and MagnetDex regarding the Site.

12. Governing Law

These Terms are governed by Spanish law. If you are a consumer resident in the EU, EEA, or UK, the mandatory consumer protection provisions of your country of residence also apply and take precedence over any conflicting term here.

13. Changes to These Terms

We may revise these Terms at any time. Continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
